This agreement ("Agreement") is made and entered into between "HJ Concrete and Landscaping Services", hereinafter referred to as the "Company," and the individual or entity booking onsite inspection services, hereinafter referred to as the "Client."
1. Services:
The Company agrees to provide onsite inspection services for landscaping and concreting work as requested by the Client. The scope of services will be determined based on the information provided by the Client and as agreed upon between the parties.
2. Booking:
2.1. The Client agrees to book onsite inspection services by contacting the Company through the designated channels and providing necessary information such as location, date, and time preferences.
2.2. The Company provides this service free of charge.
3. Cancellation and Rescheduling:
3.1. The Client may cancel or reschedule the onsite inspection by providing reasonable notice to the Company within 48 hours.
3.2. While the service is free, the Company appreciates timely cancellations to optimize scheduling.
4. Liability:
4.1. The Company shall not be liable for any damages, losses, or expenses incurred by the Client as a result of the onsite inspection, including but not limited to damages to property or errors in the inspection report.
4.2. The Client acknowledges that the onsite inspection is for informational purposes only and does not guarantee the accuracy or suitability of the proposed landscaping or concreting work.
5. Confidentiality:
5.1. Both parties agree to maintain the confidentiality of any proprietary or confidential information disclosed during the onsite inspection.
5.2. The Client acknowledges that any information obtained during the onsite inspection is for their use only and may not be disclosed or used for any purpose other than the intended project.
6. Governing Law and Dispute Resolution:
6.1. This Agreement shall be governed by and construed in accordance with the laws of State of Victoria.
6.2. Any disputes arising out of or relating to this Agreement shall be resolved through good faith negotiations between the parties. If the parties are unable to resolve the dispute amicably, either party may pursue legal remedies as provided by law.
7. Entire Agreement:
This Agreement constitutes the entire understanding between the parties with respect to the subject matter hereof and supersedes all prior agreements, understandings, and negotiations, whether written or oral.
8. Amendments:
No amendment or modification of this Agreement shall be valid unless in writing and signed by both parties.
By booking onsite inspection services with the Company, the Client acknowledges that they have read, understood, and agreed to abide by the terms and conditions outlined in this Agreement.
